Stage 04 of 07 · Evidence of use report

Evidence of Use Reports

Documented proof that a product uses your invention.

A licensee pays when it can see that its product practises your claims. An Evidence of Use (EoU) report puts that proof on paper, element by element, drawn from public sources the other side can check for themselves.

We build the evidence before we build anything expensive. Each pairing passes a set of checkpoints first, so weak matches are dropped early and budget goes only to pairings that will hold.

What we do

  • Product identification Find products that may practise the claims, across companies and regions.
  • Mapping matrix Score every patent against every candidate product, element by element, before any chart is drawn.
  • Technical evidence Quote product manuals, datasheets, filings and teardown reports, each with its source link. Lab testing is arranged where public sources are not enough.
  • Expert review Check claim construction with partner patent counsel.
  • Risk assessment Flag design-arounds, invalidity risk and weak elements.

A US public research university, carbon capture portfolio

Challenge

18 patents in carbon capture and CO2 conversion, and four candidate commercial technologies to test them against.

What we did

We built a full mapping matrix of 72 pairings. Eighteen came out as primary fits. One candidate scored far lower across the portfolio (36% average coverage against 51% for the leading products), so we recommended re-pairing rather than charting it. One promising pairing failed the preamble checkpoint: the patent required a fluidised-bed process and the product used a different cycle entirely.

Result

A ranked set of primary-fit pairings to take forward to claim charts, and no spend on charts for pairings that would not have survived scrutiny.
